Application of Terms of Use

This website is offered to customers and is conditional on their acceptance without change of the terms of use contained here. Their use of this website means they agree to all such terms of use. We may change or update these terms so please check this page specially before placing an order.

Article 1 - PRICES

1.1       All prices of products on the website are the price for the products only, in Euros. They will include VAT and shipping and handling when an order is placed. (VAT is only for European countries).

1.2       Please note that in some countries additional duties may be payable to your local tax authorities on receipt of your delivery. You will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order. Please also note that you must comply with all applicable laws and regulations of the country for which the Products are destined. We will not be liable for any breach by you of any such laws.

Article 2 – Orders and Account

2.1 - Account

There is no need to create an account to place an order. However, the customer shall provide correct information, specially e-mail address. when an order is placed.

2.2 – Payment

Payment accepted for orders on the website is Paypal..

No data related to payment is collected by the Nattofranco website. The payment is made directly via the financial supplier (Paypal).

Orders and invoices are filed on the website. They will be considered as a proof of the related exchanges, orders, payment and transactions.

Article 3 – Order confirmation

The customer declares that he is informed and has accepted these terms of use before placing an order. Confirmation of his order means accepting these terms of use.

Article 4 – Availability

The availability of products is mentioned on the website in the description of each article. If an article happens to be unavailable after the order is placed, the customer will be informed. The order will be automatically cancelled and the amount of the order will be refunded.

Article 5 – Delivery

Products will be delivered at the delivery address mentioned by the customer when the order is placed.

Except otherwise stipulated on the website, when the order is placed, Nattofranco will deliver products in maximum 7 days to France and 15 days for other countries ; however Nattofranco will not be held responsible for delays related to Delivery Services.

Once a product has been collected by the Delivery Service on your behalf, all risk of damage to, or loss of the product shall pass to you.

Article 6 – Mistakes and delivery delays

If the customer’s parcel is returned to Nattofranco by Post, Nattofranco will contact the customer . If the customer refused the parcel by mistake he can ask the parcel to be delivered again and will be charged with postal cost for the new delivery, even if the shipping was free of charge when the order was placed.

In case of mistake in delivery or exchange, any product to be exchanged or refunded shall be returned to Nattofranco in perfect condition. Any defect related to handling by the customer will not be Nattofranco’s responsibility.

In case of delay in delivery, an e-mail will be sent the customer with the new delivery time.

Any delay in delivery of over 30 days from the date when the order is placed can cause the cancellation of the order by the customer according to articles L 216-2, L 216-3 and L 241-1 the French “code de la consommation”. The customer shall send the request by e-mail. The order will be reimbursed within 14 days from the date of e-mail. This clause will not be applicable in case of Act of God.

Article 7 – Reception

If the parcel is damaged or opened, the customer shall notify immediately to the Delivery Service and to Nattofranco. The customer may refuse a parcel in such case.

In order to be able to refuse the delivery, the customer will have to open the parcel and ask the Delivery Service to take the products back. Otherwise Nattofranco will not be obliged to accept the customer’s refusal.

Article 8 – Cancellation and returns

8.1 – Cancellation right

According to statutory rights to consumers : (article L.221-18 of French “Code de la Consommation”), the customer may cancel the order within 14 days from the date of the order without giving any reason nor pay any penalty.

8.2 – Cancellation process

In case of cancellation within 14 days, only the amount of articles ordered and shipping will be paid back. The cost of shipment back to Nattofranco will be borne by the customer..

The shipment back to Nattofranco shall include complete and undamaged articles (packing and accessories) so that the articles can be sold again. The customer will be held responsible in case of damage caused by him. In such case the cancellation of order will not be possible.

In order to cancel an order within 14 days the customer can use the model included at the end of the Terms of Use (Addendum 1), and sent it by e-mail to Nattofranco within 14 days. After sending the mail, the customer shall return the articles within 14 days.

In case of such cancellation Nattofranco will pay back the amounts paid within 14 days from the date of return of the order by the customer.

Article 9 – Warranty

9.1 – Conformity of products

Nattofranco reimburses or exchange products that are obviously defective or which do not correspond to the customer’s order. The customer shall contact Nattofranco as soon as possible.

The shipment back to Nattofranco shall include complete and undamaged articles (packing and accessories). Shipment to the customer will be reimbursed and shipment back to Nattofranco will be reimbursed based on supporting shipping documents.

9.2 – Returns & Exchange policy

The customer may cancel his order if he is not satisfied, without giving any reason, within 14 days. Nattofranco will reimburse the amount of the order.

Article 10 – Liability

Nattofranco will be held responsible only in case of gross fault. In other cases Nattofranco will not be held responsible.

Products sold are in accordance with the French Law. Nattofranco will not be held responsible regarding the law of countries where products are delivered. The customer has to check with local authorities the right to import the products.

Article 11 – Intellectual Property

11.1 The Nattofranco brand name and content on the website, illustrations, images, logos are and remain the exclusive property of Nattofranco. It is protected by applicable copyright laws.  All such rights are reserved.

Article 13 – Data protection

Nattofranco does not collect nor keep PayPal or credit/debit card information.

Data collected related to the customer are necessary to the management of the orders and sales relationships. They can be transmitted to companies who take part in these relationships such as the the ones in charge with the order handling or payment. Informations are kept for security in order to respect the legal obligations and to allow Nattofranco to improve services proposed.

According to the French law “informatique et libertés” dated 6th January 1978, the customer has access to amend or refuse that data are kept. Therefore, he should send a mail to Nattofranco with a copy of ID with his signature. A response will be sent within 2 months.
